This Agreement
Effective Date: 24th March 2022

These Terms of Service (the "Terms") are a legal agreement between you and the British
Speedway Network (collectively, “BSN”, “we”, “our, “us”), governing your access to and use
of the websites and online services that display or provide an authorised link to these Terms
(collectively, the "Services").
British Speedway Network is a trading name of Exstream Media Ltd. This agreement is
therefore between you and Exstream Media Ltd only.
Please read the Terms carefully before using the Services. You may wish to print a copy of
these Terms or save them to your device for future reference. Your use of the Services
indicates your acceptance and agreement to be bound by the Terms. Do not use the
Services if you do not accept the Terms.
You must be 18 years or older to use the Services. Your acceptance of the Agreement
provides you with a limited and temporary licence and permission to use the software and
other resources of the Services, which licence and permission we may revoke at any time,
as described below.
THIS AGREEMENT CONTAINS DISCLAIMERS OF WARRANTIES (SECTION 10),
DISCLAIMERS OF LIABILITY (SECTION 11), PLEASE READ IT CAREFULLY.
Subscription Services
Certain Services may be available only through creation of a subscription account and
payment of a fee ("Subscription Services"). Through such Subscription Services accounts,
you will have access to the Subscription Services for a fixed term, which may renew
automatically as described in these Terms.
There are 3 types of Subscription Service available to purchase via BSN:
(i) SEASON PASS: Season Passes give access to all the Subscription Services that are
detailed at the time of purchase for the entire speedway season which that Season Pass
offers access to, and will expire 3 months after the season has concluded.
(ii) SEASON PASS PAID MONTHLY: Season Passes paid in monthly instalments give
access to all of the Subscription Services that are detailed at the time of purchase for the
entire speedway season which that Season Pass offers access to, and will expire 3 months
after the season has concluded.
Subscribers can end their Subscription Service at any time, with no penalty other than loss
of access to the Subscription Services (please see the ‘Cancellation’ section for more
details).
Please note that there are no guarantees on the minimum number of streams that will be
shown each month, only a guarantee that the full quota of meetings detailed at purchase will
be delivered over the course of the season.
(iii) SINGLE MATCH PASS: Single Match Passes give live & on-demand access to a single
meeting only. If purchased after a livestream has ended, only on-demand access will be
available.

PLEASE NOTE THAT BSN SEASON PASSES DO NOT COVER EVERY MEETING THAT
IS BROADCAST ON BSN, ONLY THE MEETINGS THAT ARE DEFINED AT THE TIME OF
PURCHASE. WE MAY OCCASSIONALLY OFFER SINGLE MATCH PASSES FOR EVENTS
THAT ARE NOT PART OF OUR SEASON PASS SUBSCRIPTION SERVICES, WHEN A
CLUB OR INDIVIDUAL OFFERS US AN ADDITIONAL STREAMING OPPORTUNITY.
Should the streaming of any match which is included as part of a Season Pass be
postponed, an alternative match, which may take place at a later date, will be chosen to
replace it, unless the postponed match officially has a result declared. Season Pass holders
will only be offered a partial refund in the unlikely event that we cannot fulfil the full quota of
streams detailed at the time of purchase.
Please refer to the ‘Registration for Non-Subscription Services and Single Match Purchases’
section for Single Match Pass refund policy.

Access Restrictions:
Season Pass and Single Match Pass purchases grant a single subscriber access to the
Subscription Services. ACCOUNT SHARING IS PROHIBITED AND STREAMING
RESTRICTED TO ONE DEVICE AT A TIME. IF A LIVESTREAM IS DETECTED TO BE
PLAYING ON MORE THAN ONE DEVICE AT THE SAME TIME, ACCESS WILL
AUTOMATICALLY BE REVOKED ON ONE OF THESE DEVICES.
You are not authorised to access any Subscription Services unless you:
(i) have opened a subscription account with the BSN and paid the appropriate fee;
(ii) have received access credentials (including a username and password), and
(iii) are using those access credentials.
THE USE OF VPN SOFTWARE AND ANONYMOUS BROWSERS TO ACCESS BSN'S
SUBSCRIPTION SERVICES IS STRICTLY PROHIBITED AND MAY RESULT IN ACCOUNT
SUSPENSION OR TERMINATION.
YOU MAY NOT ASSIST ANYONE ELSE IN ACCESSING SUBSCRIPTION SERVICES ON
AN UNAUTHORISED BASIS, INCLUDING BY SHARING, SELLING, PUBLICLY
OFFERING, OR OFFERING TO SELL YOUR ACCESS CREDENTIALS OR PROVIDING
ANY CONTENT OR OTHER MATERIALS THAT YOU OBTAINED THROUGH
SUBSCRIPTION SERVICES TO THIRD PARTIES OR OTHERWISE IN VIOLATION OF
THESE TERMS.
THE SERVICES, INCLUDING ALL LIVE-STREAMED EVENTS, ARE INTENDED FOR
PRIVATE USE ONLY. IF YOU WISH TO SHOW THE SERVICES IN A PUBLIC PLACE,
PLEASE CONTACT SUPPORT@EXSTREAMMEDIA.CO.UK TO OBTAIN A COMMERCIAL
LICENCE.
You are responsible for maintaining the confidentiality of your access credentials and if you
know or suspect that anyone other than you knows your access credentials, you must
promptly notify us. You are also responsible for all usage or activity on your Subscription
Services accounts, including the use of Subscription Services by any third party authorised
by you to use your access credentials. Such responsibility expressly includes any purchases
made or other charges incurred on your credit or debit card in connection with your use (or
an authorised third party's use) of the Subscription Services. In the event of any fraudulent,

abusive, or otherwise illegal activity on your Subscription Services accounts, we may, in our
sole discretion, terminate those accounts and refer you to appropriate law enforcement
agencies. You may be responsible for damages from any such fraudulent, abusive, or
otherwise illegal activity.

Access to the Services:
In order to access the Services, you must have access to the World Wide Web, either
directly or through devices that access Web-based content, and must pay any service fees
associated with such access. Not all of the features available through the Services, including
certain live streaming audio, video or access to high-quality video, will be available to you
unless your computer or mobile device satisfies the minimum technical requirements for the
Services. As we make changes to the Services, the minimum technical requirements for
access to the Services may change. You are responsible for determining whether your
computer or device satisfies the minimum technical requirements before you register to
access the Services. Moreover, if we change the minimum technical requirements after you
initially register to access the Services such that your computer or device no longer satisfies
the requirements, your exclusive remedy will be to request termination of your access to the
Services.

Availability of Services and Technical Assistance
The availability of the content on the Services may be affected by a variety of factors,
including match delays or cancellations, technical problems or network delays, program
rescheduling, or other reasons. All services provided over the internet are vulnerable to
technical problems at times and are by no means guaranteed. You agree that we are not
obligated to provide you with any specific content under this Agreement and all live-streams
are provided as is. Technical assistance may be unavailable during a live-stream, but we will
endeavour to provide a solution which allows you to watch at a later date should you have
technical issues resulting from your own internet supply, device compatibility or ability to use
our platform.

Registration, Username, Password, Security:
(a) Registration. Registration may be required for certain portions of the Services. We will
not grant any user access to any registration-required portions of the Services unless he or
she has completed the necessary registration and paid the fees, if any, associated with
access to such portion of the Services.
(b) Your User Identity. Your username and password will be your identity for purposes of
interacting with the Services and other users through the Services.
(c) Username, Passwords, and Password Access. You shall keep confidential, shall not
disseminate, and shall use solely in accordance with this Agreement, your username, and
password for the Services. You shall immediately notify us if you learn of or suspect: (i) any
loss or theft of your username or password, or (ii) any unauthorised use of your username or
password or of the Services. In the event of such loss, theft, or unauthorised use, we may
impose on you, at our sole discretion, additional security obligations.

(d) Security Breaches and Revision. If any unauthorised person obtains access to the
Services as a result of any act or omission by you, you shall use your best efforts to
ascertain the source and manner of acquisition and shall fully and promptly notify us by
email at support@exstreammedia.co.uk. You shall otherwise cooperate and assist in any
investigation relating to any such unauthorised access.

Suspension or Termination:
We may suspend or terminate your access to Subscription Services at any time without
notice to you. If we do so, you will not be responsible for fees associated with the
Subscription Services after the termination becomes effective, but you will not have any
other remedies against us, and we will not issue any refunds. If you have breached or
violated any obligation under these Terms, you will not be entitled to any remedy.

Billing and Payment:
• Age and Billing Authorisation. By subscribing to a Subscription Service, you confirm that
you are at least 18 years of age, that all information you submit is true and correct (including
all credit or debit card information), and that you are the authorised holder of the credit or
debit card.
• Fees. You agree to pay all subscription fees and other charges to your Subscription
Services accounts.
• Value Added Tax. BSN is required to collect VAT. Purchases from the services are not
exempt from VAT simply because they are made from the internet. All Subscription Service
fees advertised are inclusive of VAT.

Automatic Renewal:
• YEARLY SUBSCRIPTION SERVICES (SEASON PASS). For Subscription Services billed
on a yearly basis, your subscription will not automatically renew for the following season.
• YEARLY SUBSCRIPTION SERVICES PAID IN MONTHLY INSTALMENTS (SEASON
PASS PAID MONTHLY). For Subscription Services billed on a monthly basis, your
subscription will automatically renew monthly during the current season, at the same
monthly subscription price, unless you cancel your Subscription Service prior to the
beginning of the next applicable billing (and renewal) period. Subscription Services paid in
monthly instalments will stop renewing after the required number of payments (defined at the
time of purchase) have been paid. The primary credit or debit card you have stored in the
Billing section of your BSN account will be charged on or about the same date each month
of your subscription, with Subscription Services remaining active until the same day of the
following month. If we are unable to process these charges to your primary credit or debit
card, an alternative card stored in the Billing section of your BSN account may be charged. If
you wish to cancel a Subscription Service, you may cancel your subscription in its entirety.
To cancel a Subscription Service, you may login to your BSN account, access the My
Account section and follow the applicable instructions, or send an email to
support@exstreammedia.co.uk. In no event will BSN provide partial or prorated refunds.
Please see the Cancellation Section below for details regarding refunds.

UNLESS YOU NOTIFY US BEFORE THE BEGINNING OF THE NEXT APPLICABLE
BILLING (AND RENEWAL) PERIOD THAT YOU WISH TO CANCEL ANY
AUTOMATICALLY RENEWING SUBSCRIPTION SERVICE, YOUR SUBSCRIPTION
SERVICE WILL AUTOMATICALLY RENEW AND YOU AUTHORISE US (WITHOUT
NOTICE TO YOU) TO COLLECT THE APPLICABLE SUBSCRIPTION FEE, INCLUDING
VAT, USING ANY CREDIT OR DEBIT CARD STORED IN THE BILLING SECTION OF
YOUR BSN ACCOUNT.

Trial Subscriptions:
Access to a Subscription Service may from time to time be made available on a time-limited
free trial basis (a "Trial Subscription"). Please note that these Terms apply to a Trial
Subscription. You may be asked to provide your credit or debit card information when
registering for a Trial Subscription. In such event, your credit or debit card will only be
charged if you do not cancel your Trial Subscription before the end of the Trial Subscription
period. If we ask for your credit or debit card information and you do not affirmatively cancel
before the end of the Trial Subscription, then your Trial Subscription may be converted into a
paid subscription and your credit or debit card may be charged the subscription fee in effect
at the time your Trial Subscription ended. By subscribing for a Trial Subscription, you:
(i) acknowledge that the Trial Subscription is personal to you and may not be transferred or
otherwise assigned to any other person;
(ii) acknowledge that the Trial Subscription is intended to permit you to assess the
Subscription Services for consideration of a full subscription to the Pay Service (a "Paid
Subscription"); and
(iii) acknowledge that the Trial Subscription may be subject to other terms and conditions
specific to the Trial Subscription being offered, and your use of the Subscription Service
during the Trial Subscription period will also be subject to such other terms and conditions
and such other terms and conditions shall be incorporated into the Terms; and
(iv) ACKNOWLEDGE THAT IF YOU ARE REQUIRED TO PROVIDE YOUR CREDIT OR
DEBIT CARD INFORMATION AND THE TRIAL SUBSCRIPTION IS NOT CANCELLED
WITHIN THE TRIAL SUBSCRIPTION PERIOD, YOUR TRIAL SUBSCRIPTION WILL
CONVERT TO A PAID SUBSCRIPTION THE PRICE OF WHICH WILL BE EQUAL TO THE
PRICE OF A PAID SUBSCRIPTION IN EFFECT AT THE TIME THE TRIAL SUBSCRIPTION
BEGAN AND THE CREDIT OR DEBIT CARD YOU PROVIDED WILL AUTOMATICALLY BE
BILLED.

Cancellation:
To cancel your subscription to Subscription Services, you must follow the procedures
described below. Except as described below, we do not refund or prorate Subscription
Services, or any other purchases made through the Services, for any reason. Requests to
terminate subscriptions will be effective once the billing period in which we received the
cancellation concludes.
Subject to applicable laws, if you are a subscriber to BSN, you may cancel your subscription
within five (5) days of initially subscribing or within five (5) days after your subscription has

automatically renewed, and receive a refund of the subscription price, unless you have
already used the Subscription Service to watch any live-streamed event, or an on-demand
event that had previously been offered as a live-streamed event during those five (5) days. If
you sign up for BSN again after cancelling, BSN reserves the right to deny further
cancellation requests made within a single season.
You may cancel your subscription easily within the Billing section of your BSN account, by
selecting ‘Change Plan’ and then ‘Cancel Membership’.

Registration for Non-Subscription Services and Single Match Purchases
You may be asked to register for certain activities in connection with the Services, including
those Services other than Subscription Services. When you register or provide any other
information in connection with the Services, you agree to provide accurate, current, and
complete information about yourself as requested or directed and to promptly update this
information to maintain its accuracy. BSN has the right to suspend or terminate any account
or other registration and to refuse any and all current or future use if it suspects that such
information is inaccurate or incomplete. You are responsible for maintaining the
confidentiality of any password and username that you are given or select, and you are
responsible for all activities that occur under your password or account.

Single Match Purchases (Single Match Pass):
For purchasers of a single live-stream, a refund may be granted in part, or in full, dependent
upon the following:
• In the event of a match cancellation or a technical failure on our part which prevents a live-
stream from taking place, a refund will automatically be issued.
• In the event of a technical failure on your part, or an abandonment of a match after heat 10
has taken place (or heat 12 for any match that consists of more than 15 heats), a refund will
not be available.
• In the event that a match starts but is abandoned before heat 10 has concluded, a refund
of 10% per uncompleted heat, up until heat 10 will be issued automatically (this is increased
to heat 12 for any match that consists of more than 15 heats, with the maximum refund
being 100%).
• Refunds will be deposited back to the card used for purchase within 5 – 10 working days.
• All live-streamed events are intended for private use only. If you wish to show the live-
stream in a public place, please contact support@exstreammedia.co.uk to obtain a
commercial licence.
The availability of the live-stream may be affected by a variety of factors, including technical
problems, network delays, or other reasons. All services provided over the internet are
vulnerable to technical problems at times and are by no means guaranteed, therefore, all
live-streams are provided as is. Technical assistance may be unavailable during a live-
stream, but we will endeavour to provide a solution which allows you to watch at a later date
should you have technical issues resulting from your own internet supply, device
compatibility or ability to use our platform.

Prohibited Content and Activities
You may not access or use, or attempt to access or use, the Services to take any action that
could harm us or any other person or entity (each a "person"), interfere with the operation of
the Services, or use the Services in a manner that violates any laws. For example, you may
not:
• Impersonate any person or falsely state or otherwise misrepresent your credentials,
affiliation with any person, or the origin of any information you provide;
• Engage in unauthorised spidering, scraping, or harvesting of content or information, or use
any other unauthorised automated means to compile information;
• Solicit, collect, transmit, store, or otherwise make available private information of any third
party including, without limitation, telephone numbers, addresses, last names, email
addresses, or credit or debit card numbers;
• Obtain or attempt to gain unauthorised access to other computer systems, materials,
information, or any services available on or through the Services;
• Use any device, software, or routine to interfere or attempt to interfere with the proper
working of the Services or any activity conducted on the Services or attempt to probe, scan,
test the vulnerability of, or breach the security of any system, device, or network;
• Use VPN software and anonymous browsers to access the Subscription Services;
• Circumvent, reverse engineer, decipher, decompile, disassemble, decrypt, or otherwise
alter or interfere with (or attempt, encourage, or support anyone else's attempt to engage in
such activities) any of the software comprising or in any way making up a part of the
Services. The use or distribution of tools designed for compromising security (e.g., password
guessing programs, cracking tools, or network probing tools) is strictly prohibited;
• Use or attempt to use another's information, account, password, service, or system except
as expressly permitted;
• Take any action that imposes an unreasonable or disproportionately large load on our
network or infrastructure;
• Upload or otherwise transmit any communication, software, or material that contains a
virus or is otherwise harmful to our or our users' computers, devices, or systems; or
• Engage in any other conduct that restricts or inhibits any person from using or enjoying the
Services, or that, in our sole judgment, exposes us, users, or any other third party to any
liability, damages, or detriment of any type.
Violations of system or network security and certain other conduct may result in civil or
criminal liability. We may investigate and work with law enforcement authorities to prosecute
users who violate the Terms. We may suspend or terminate your access to the Services for
any or no reason at any time without notice.

Privacy Policy

We are committed to protecting your privacy and security and we have explained in detail
the steps we take to do so in the Privacy Policy, a copy of which you should review. You, in
turn, agree and consent to the terms of the Privacy Policy by your use of the Services.
In order to register for BSN’s free and Subscription Services, you may be required to provide
complete and accurate personal information, including, without limitation, your name,
address, telephone number, e-mail address, credit card information and billing address. Our
Privacy Policy explains how such information collected via the Services may be used by us.
By using the Services, you acknowledge that you have reviewed and understand our Privacy
Policy. You agree (i) to provide accurate, current, and complete information about yourself as
may be prompted by any registration or other forms (collectively, "Registration Data"); (ii) to
maintain the security of your password and identification; (iii) to maintain and promptly
update Registration Data and any other information you provide to BSN; (iv) not to sell,
transfer, or assign your account; and (v) to be fully responsible for all use of your account
and for any actions that take place using your account.

Intellectual Property
All content, information, computer code, software, and any other materials that are part of
the Services other than your User Content (collectively, the "BSN Content") is the property of
the BSN or third parties. You may access, use, and display the Services and print copies of
the BSN Content only for non-commercial, informational, personal use, without modification
or alteration in any way, and only so long as you comply with these Terms.

Copyright and Other Intellectual Property Rights
BSN Content is protected under the copyright laws of the United Kingdom and other
countries. You acknowledge that all copyrights and other intellectual property rights related
to the Services are owned by the BSN or its third-party licensors to the full extent permitted
under the UK copyright law, international copyright laws, and all other applicable laws.
Unless expressly permitted by an authorised person in writing or as permitted by applicable
law, you may not copy, reproduce, distribute, publish, enter into a database, display, perform,
modify, create derivative works from, transmit, or in any way use or exploit any part of the
BSN Content. To obtain written consent to use a copyrighted work, please contact us using
the information in Section 20. Copying or downloading BSN Content other than as stated
above is a violation of these Terms.

Trade and Service Marks
We and our member professional speedway clubs own all rights in the product names,
company names, trade names, logos, product packaging and designs ("Trademarks") of the
organisations it works with and such member clubs, and third parties own all Trademarks in
their respective products or services, whether or not appearing in large print or with the
trademark symbol. Unauthorised use of any such Trademarks, including reproduction,
imitation, dilution or confusing or misleading uses, is prohibited under the trademark laws of
the United Kingdom and other countries. You are expressly prohibited from using or
misusing any Trademarks and nothing otherwise stated or implied in the Services confers on
you any licence or right to do so.

Notice of Infringement
The BSN respects intellectual property rights. If you believe in good faith that your work has
been reproduced or is accessible on the Services in a way that constitutes copyright
infringement, please provide us with the following information by email:
• An electronic or physical signature of the person authorised to act on behalf of the owner of
the exclusive right that is allegedly infringed;
• Identification of the copyrighted work or a representative list of the works claimed to have
been infringed;
• Identification of the allegedly infringing material and information reasonably sufficient to
permit us to locate the material;
• Your name, address, telephone number, and email address, so that we may contact you if
necessary;
• A statement that you have a good faith belief that the disputed use is not authorised by the
copyright owner, its agent, or the law; and
• A statement by you, made under penalty of perjury, that the above information in your
notice is accurate and that you are the copyright owner or authorised to act on the copyright
owner's behalf.

Linking to our Services
You may link to our Services provided that you do so in a way that is fair and legal and does
not damage our reputation or take advantage of it. You must not establish a link in such a
way as to suggest or imply any form of association, approval, or endorsement on our part
where none exist and no link to our Services may be "framed" to the extent such frame
contains any sponsorship, advertising, or commercial text or graphics. We reserve the right
to withdraw linking permission without notice. You must not establish a link to our Services in
any website that requires registration in connection with content from our Services or that
otherwise collects personal information in connection with content from our Services.

Links and Third Party Content
The Services may contain links to other websites or online services that are operated and
maintained by other persons and that are not under the control of or maintained by the BSN.
Such links do not constitute an endorsement by the BSN of those other websites or online
services, the content displayed therein, or the persons associated therewith. These Terms
do not apply to such other websites and online services, and such websites and online
services are not part of the Services. We encourage you to review the privacy policies and
terms of use of these other websites or services.
We may incorporate third party services, software, technology, data, and/or other content
(collectively, "Third Party Materials") either independently or in connection with various
programs, features, or functions available through the Services. Your use of Third Party
Materials may be subject to terms of use other than these Terms and as may be set forth by
third party providers, as applicable. You agree and acknowledge that the BSN assumes no

liability with respect to your use of such Third Party Materials whether you are aware of their
use or not and whether or not the use of such Third Party Materials is endorsed or
recommended by the BSN.

Disclaimer of Warranties
Your use of the services is entirely at your own risk. We make no representations or
warranties about the services, including, without limitation, the operation of the services or
the information, materials, goods, or services appearing or offered on the services or with
respect to any websites or services linked from the services. The services are provided "as
is", "with all faults," and "as available." without limiting the generality of the foregoing, we
disclaim all warranties and conditions, express, statutory, or implied, including but not limited
to (i) the warranties of merchantability, fitness for a particular purpose, workmanlike effort,
title, quiet enjoyment, no liens, and no encumbrances; (ii) the warranties against
infringement, misappropriation, or violation of any intellectual property or proprietary rights of
any person; (iii) warranties arising through course of dealing or usage in trade; and (iv) the
warranties relating to the accuracy, reliability, correctness, or completeness of data or
content made available on the services or otherwise by the BSN. Further, there is no
warranty that the services will meet your needs or requirements or the needs or
requirements of any other person or the needs or requirements set forth in any
documentation. We make no warranties, express, statutory, or implied, that the services,
including, without limitation, the BSN content, functions, or materials contained therein, will
be timely, secure, accurate, error-free, complete, up-to-date, free of viruses, or
uninterrupted. The organisations we work with do not necessarily endorse, support,
sanction, encourage, or agree with any BSN content or any user content, and we expressly
disclaim any and all representations, warranties, conditions, and liabilities in connection with
any user content or BSN content. The BSN makes no representation that the services are
appropriate or available for use outside of the United Kingdom. No oral or written information
made available by or on behalf of the BSN shall create any warranty.

If applicable law does not allow the exclusion of some or all of the above implied or statutory
warranties to apply to you, the above exclusions will apply to you to the fullest extent
permitted by applicable law.

Exclusive Remedy and Limitation of Liability
Under no circumstances, including without limitation negligence, will the BSN, its affiliates, or
any party involved in operating, creating, producing, or delivering the services be liable for
damages or losses including without limitation direct, incidental, consequential, indirect,
special, or punitive damages or lost profits arising out of the terms or your access, use,
misuse, or inability to use the services, including without limitation any BSN content or user
content, or any sites linked from the services, however caused, whether in contract, tort,
negligence, strict liability, or otherwise, even if the BSN has been advised of the possibility of
such damages, or in connection with any failure of performance, error, omission, interruption,
defect, delay in operation or transmission, computer virus, line or system failure, or other
technologically harmful material that may infect your device, data, or other proprietary
material due to your use of our services or any website linked to it.

Because some jurisdictions do not allow the exclusion or limitation of incidental or
consequential damages, the BSN's liability in such jurisdictions for such damages shall be
limited to the extent permitted by law. Nothing in these terms excludes or limits our liability
for death or personal injury arising from our negligence, or our fraud or fraudulent
misrepresentation, or any other liability if and only if such liability cannot be excluded or
limited by applicable law.
Any claim against us shall be limited to the amount you paid, if any, for use of the services.

Indemnification
You agree to indemnify, hold harmless, and defend BSN, its affiliates and licensors, member
clubs and speedway organisations, any party involved in operating, creating, producing, or
delivering the Services (including the Subscription Services), and each of their respective
officers, owners, directors, shareholders, contractors, agents, employees, general and
limited partners, successors, and assigns from and against any and all demands, claims,
damages, liabilities, judgments, fines, interest, penalties, losses, costs, expenses, and
harms, including without limitation reasonable solicitor’s' fees and fees of other professional
advisers, arising out of or in connection with (i) your use of the Services (including, without
limitation, your User Content and your use of any BSN Content), (ii) your online conduct in
connection with the Services, (iii) your violation or breach of these Terms, (iv) your failure to
comply with any applicable laws or regulations in connection with the Services, (v) your
negligence, wilful misconduct, or violations of the intellectual property or other rights of any
person in connection with the Services, or (vi) any of your dealings or transactions with other
persons resulting from use of the Services. You shall not settle any such claim without the
prior written consent of the BSN. These obligations will survive any termination of these
Terms.

Integration and Severability and Amendment
These Terms constitute the entire agreement between the BSN and you, superseding any
prior or contemporaneous communications and proposals (whether oral, written, or
electronic) between you and us. In the event any provision of these Terms is held
unenforceable, it will not affect the validity or enforceability of the remaining provisions and
will be replaced by an enforceable provision that comes closest to the intention underlying
the unenforceable provision.
BSN in its sole discretion may amend these Terms, for example to reflect changes in laws or
regulatory requirements, in which case we will post the amended Terms within the Services.
You should therefore periodically visit this page to review the then-current Agreement. Your
use of the Services after such amended Terms are posted will constitute acceptance of them
by you. BSN may be required to notify you of certain events concerning the Services and
your use thereof, and your use of the Services constitutes acceptance that such notices will
be effective upon our posting them on the applicable Services or, if we elect in our sole
discretion, emailing you at an address you have provided to us.
We reserve the right, in our sole discretion, to restrict, suspend, or terminate your access to
and use of the Services, with or without prior notice. The BSN is not responsible for any error
in copy or images relating to the Services or any other products offered via the Services. Any

offer to sell any Services or any other products offered via the Services may be discontinued
at any time in BSN's sole discretion.
Otherwise, applicable sections of these Terms shall survive termination. The BSN also
reserves the right to seek all remedies available at law and in equity for violations of these
Terms. Upon termination, you must cease all use of the Services, including any of the BSN
Content.

No Waiver
Our failure to enforce any provisions of the Terms or respond to a breach by you or other
parties shall not in any way waive our right to enforce subsequently any terms or conditions
of the Terms or to act with respect to similar breaches.

Assignment and Binding Effects
You may not assign these Terms or any rights or obligations herein without the prior written
consent of the BSN and any attempted assignment in contravention of this provision is null
and void and of no force or effect. The BSN has the right to assign these Terms, and any of
its rights or obligations herein. These Terms are binding upon each party and its respective
successors, heirs, trustees, administrators, executors, and permitted assigns.

Governing Law
The Services are operated out of the UK. We do not represent that content or materials
presented on the Services are appropriate for use in other locations. If you access the
Services from a jurisdiction other than the UK, you agree that you do so on your own
initiative, and are responsible for compliance with local laws, if and to the extent local laws
are applicable to your use of the Services. By using the Services, you waive any claims that
may arise under the laws of other countries, territories, or jurisdictions.
By using the Services, you represent and warrant that you will not use the Services for any
purpose that is either unlawful or prohibited by this Agreement. We reserve the right to
disclose any information about you or your use of the Services in connection with any
investigations by us or law enforcement authorities as may be appropriate or necessary to
satisfy any applicable law, regulation, legal process or governmental request.

No Professional Advice
Any information supplied by any of our employees or agents, whether by telephone, e-mail,
letter, facsimile or other form of communication, is intended solely as general guidance on
the use of the Services, and does not constitute legal, tax, accounting or other professional
advice. Individual situations and state laws vary and users are encouraged to obtain
appropriate advice from qualified professionals in the applicable jurisdictions. We make no
representations or warranties concerning any course of action taken by any person following
or otherwise using the information offered or provided within or through the Services, and we
will not be liable for any direct, indirect, consequential, special, exemplary or other damages
that may result, including but not limited to economic loss, injury, illness or death.

Separate Terms and Conditions
In connection with your use of the Services, you may be asked to consent to policies or
terms and conditions in addition to these Terms. Please read these supplemental policies
and terms carefully before making any use of such portions of the Services. Any
supplemental terms will not vary or replace these Terms regarding any use of the Services,
unless otherwise expressly stated.

By using any service, you signify your agreement to these terms. If you do not agree to
